Suara.com – Acting Governor of DKI Newsdelivers.com Heru Budi Hartono will gather second echelon officials tomorrow. What was discussed was related to the neutrality of the State Civil Apparatus (ASN) in the 2024 Election.
Heru explained that there are many regulations that require ASN to be neutral in elections. One of them is contained in Law Number 5 of 2014 concerning ASN.
“Tomorrow I will gather all echelon two, remind them again. Yes, ASN must be neutral,” said Heru at DKI Newsdelivers.com City Hall, Wednesday (18/10/2023).
Heru explained that ASNs were not only asked not to show their closeness to candidates who will compete in next year’s democratic party. Especially a photo with one of the presidential and vice presidential candidates.

“Even just taking a photo, I took a photo of the candidate with Mr. Michael, that’s not allowed. That’s what I want to remember. Sharing is not allowed,” explained Heru.
Furthermore, Heru then asked the public to believe in the neutrality of DKI ASN.
“Be confident in DKI ASN, hopefully they will be neutral, serving and continuing to work as usual, serving as usual,” explained Heru.
ASN Rules Must Be Neutral
Previously Bawaslu Member Lolly Suhenty said there were at least three laws that emphasized that ASN must be neutral.

First, Law Number 5 of 2014 concerning State Civil Apparatus. Article 2 states that every ASN employee must comply with the principle of neutrality by not taking sides from any form of influence and not taking sides with certain interests.
Secondly, Law Number 7 of 2017 concerning General Elections also contains an article regarding the neutrality of ASN.
Third, Law Number 10 of 2016 concerning regional head elections contains two articles that regulate the neutrality of ASN, namely Article 70 and Article 71.

Article 70 paragraph (1) states that in the campaign, candidate pairs are prohibited from involving the State Civil Apparatus, members of the Indonesian National Police, and members of the Indonesian National Army. Violation of these provisions is subject to criminal sanctions of a maximum of 6 (six) months in prison and a fine of a maximum of 6 million as stated in Article 189.
Then, Article 71 paragraph (1) states that state officials, state civil servants, and Village Heads or other names/Lurahs are prohibited from making decisions and/or actions that are beneficial or detrimental to one of the candidates during the Campaign period. Violation of these provisions is subject to criminal sanctions of up to 6 (six) months in prison and a fine of up to 6 million as stated in Article 188.
“These 3 laws regulate the norm that ASN must be neutral. There is no need to be confused anymore, the three laws talk about ASN having to be neutral, what is allowed and what is not allowed, it is also contained in the SKB of five institutions,” he stressed as quoted from Bawaslu.go.id .
